The office of Democratic Attorney General Chris Mayes, which is prosecuting Ganches’ execution, said a briefing schedule should be established to ensure corrections officials meet execution requirements, including testing for the pentobarbital that will be used in his lethal injection.
Two years ago, Ganches called on the state Supreme Court to issue a death warrant for him on the grounds that justice could be served and the victim’s family’s file could be closed.

Ganches was scheduled to be executed in April 2023, before Democratic Governor Katie Hobbs’ office announced that the state was not ready to carry out the death penalty because it did not have the staff with the necessary experience to carry out executions.
Hobbes had pledged not to carry out any death sentences until there was confidence in the state’s ability to carry them out without violating any laws. Hobbs had ordered a review that effectively ended in November when she fired the retired federal judge she had appointed to lead the review.
